And to be honest, Azoff probably handled that deal when CD was turned over. Merck didn't get a lot of shit done in his time with the band except some merchandise stuff.
To be fair, Merck had to operate without an album or Universal backing, as the album didn't come around in his time. Since 2004, there was no funding for the project other than what Merck and Axl apparently got via Sanctuary, so Merck would've had his hands full in supplying the band whatever was needed to complete the album and book a big tour to cover the overhead.
Azoff came in initially as a godsend, as far as the public reception went. People realized this was someone powerful and savvy enough to throw the double-six and make the deal that would get CD out of the legal wrangle. He did, only that he didn't (apparently) initiate the BestBuy deal, but rather saw it through.
Even so, IMO the best thing MSL might have in terms of an album #2 contract, would be an email by either Guns or Uni reps, either setting some terms or responding to them. Guns may have a contract for a second album in place now, but I seriously doubt they would've had it back in 2007.

Unless you choose to believe Uni was touched by Axl's open letter and offered contracts to not one but two albums a month after Merck was fired.

In terms of quantity, most of that stuff appears to be from 2008.
And all these WikiLeaks are going to do is more publicity. I mean, is it really news to anyone that Axl's a bit unstable?

they are all hanging on hoping to get Axl to sing on some of their submitted music. None of them have been on million selling albums before so the royalty and publishing check will be bigger than anything they've had before.

Take a look at this clip. A good band can elevate a mediocre song and make a great one a classic. The intro to RQ is wicked cool, with Frank's soulful drumming and Ashba's screeching intro. The last solo is barely listenable in comparison, throwing in everything and the kitchen sink with a guitar wall nearly drowning everything in discord.
Or so it seemed.
That's when I thought the current live band definitely have a chemistry among them to perform RQ the way as I like it. That's how I'd expect to hear a proficient band arrange a 2011 cover version. They also do the Axl way of polishing forever, which is the suffocated last half of the entire song. More guitar, more noise. Never embracing the solo instrument, not giving anything front and centre; 'chaotic' sprang to mind.
I'm confident this band would have the combined song-writing prowess to write a solid, groovy album with shades of funk and metal. It wouldn't be GNR in terms of Slash, but it would be a whole lot of fun. Quick-moving, easy listening.
The only thing I fear that might ruin the album would be Axl.
