Slash wrote those guitars, not whoever played then in the band that holds the Guns N' Roses name. Axl can't rewrite history, however hard he's trying.

Does it matter if he knew? He clearly had no issues invoking the clause.
It doesn't change the ultimate outcome, but when you're talking about what someone did or didn't know, I think there should at least be some basis for that.
Anyway, it's kinda funny to see someone be so emphatic about what happened or how it happened when Duff said this on the Opie & Anthony show after his book came out:
Opie & Anthony: Did he [Axl] really come to you and Slash and wanted you to sign paper before you went on stage.
Duff McKagan: No no no. I hope that part of the book is clear. In that part of our group, I don't think there was any connection between management and the band and all of that stuff. I do think people thought Slash and I were going to die. I think there were some safe guards...the point I was trying to make was our band had gotten so out of our control.
The papers were presented to us [by management].
Opie & Anthony: Do you think it was more of a management thing than from him [Axl] personally?
Duff McKagan: To this day I don't really know.

If Duff doesn't even say that Axl was certainly behind how the contract was presented, how can anyone else?

Axl's words are crystal clear.
Also don't forget that Duff's book came out when they were trying to ease the situation between Axl and Slash to help the RRHOF reunion, and Duff was kinda the negotiator, so he had to be very diplomatic. It's easier to blame the ex-manager for all that went bad, especially since Doug lost Axl's confidence, too. However it's insane to think that Axl never knew about how he got the name that worths a fortune.

Imagine that you own a palace together with 2 of your (ex-)friends. This palace worths millions of dollars. You wanna own it alone, for whatever reason - you want the property or you think that your (ex-)friends are making a mess there all the time. You barely even talk anymore, it's a cold war between you and them.
You have a friend. A very loyal friend, who does things for you. One day he comes in and says: 'Ali, now it's your house. The others singed over their rights'. Whether you asked him to get this job done or the result came all of the sudden, doesn't matter that much right now. But. Wouldn't you be fuckin' surprised? Wouldn't you wanna know how it happened? Would you believe for a nanosecond that they signed over that million dollar worth property without getting any money for it? Wouldn't you suspect some dirty things, like blackmailing them and such?
I think the answer is pretty clear.
Also, imagine the situation: after all this happened, you ask yourself to be your paid housekeeper and gardener. They did the same job before, when you owned the palace together, but now they either accept being your employee or need to leave the house.
The situation is pretty clear.
Axl wanted power over the others at any cost. He got it. Didn't care about how. And this is the best case scenario. The other says he wanted it to happen as bad as it can get.

Yeah, I agree. I think part of the fan base is to desperate to have "Guns N' Roses" around, whatever that means. They want to get their illusion that their favourite band still exists. The others (me included) are exactly the opposite. We have the name fixation, too, but we "want to protect" our memories and would be happier if the brand weren't used after 1995-1996. Anyway, a serious amount of quality new material under whatever name would give these debates a rest forever.
I think the theory that Axl has run the GNR name into the ground or has tarnished their legacy is way overblown. When the dust settles, people are going to remember GNR from 87-93 and that's it.
He's been working very hard to tarnish the legacy, but I agree, he won't succeed. Guns N' Roses were too big and will be too relevant forever, based on their '87-'93 heyday, so the legacy will survive the last 2 decades of decadence.
However, I do hope Axl changes that and makes people take notice of this era.
That's what we've been waiting for since 1996. I still haven't entirely given up on him, but I'm afraid we believe in his ability to change (or do anything new) way too much. Maybe Axl burnt out too early, but we still cannot face it, however we've got a serious amount of "wake up, it's nostalgia trip" heads-ups in the recent years.

On second thought, perhaps an Axl Rose forced to go solo would have given us more material.
Yeah, I agree. I think part of the fan base is to desperate to have "Guns N' Roses" around, whatever that means. They want to get their illusion that their favourite band still exists.
