Who's "they"? The bank, or did the inspector just point it out? If it was just the inspector, then it's up to you how you want it handled. You can fix it yourself after purchase, have the sellers contribute cash back or a discount to cover the cost, or have them fix it.
I defer to Cramer's experience ultimately though, because he seems to have professional experience, whereas I've just been through this from the individual side a few times.

Now all we need is dedicated tour dates, a website, and a few new songs in the near future. I think we'll be good to go with that.

If they do something more together, they either need to stick to stuff they collaborated on (a la Them Crooked Vultures), or throw in songs from both "camps" (Nirvana/Beatles with more emphasis on Nirvana.) That's my guess.
HOWEVER, the thought of seeing a "2012: Reunion/New Lineup" line in Nirvana's wiki's tables of contents kind of gives me awesome chills.

Well, I'm sure Steven has already typed up his plea to join.
As soon as someone starts talking "brand", I tune out. Especially when they want you to write an essay on why you like their brand so much. I love the music. No music, no interest.
